Prefigurative Legality

Since the early 2000s, many of left groups that spurred alt-globalization movement have embraced directly democratic organizing and creation ethical relationships subjectivities far more than they pursued projects to reform legal political institutions. These practices are often described as prefigurative because people working build alternative possible futures in here-and-now outside dominant statist capitalist rationalities. In this essay, we ask if prefiguration can also involve imagining forms anew. Drawing on Amelia Thorpe, Owning Street: The Everyday Life Property (2020), discuss contemporary efforts use language, form, legitimacy law imagine it otherwise, occur through various kinds direct actions rather primarily appeals courts, legislators, or other state officials. so doing, point an emergent field critical sociolegal scholarship call legality.
